Will my partner be eligiable for hdc?

my partner has a string of driving offences but calmed down in his late 20's thankfully but a few week ago i was having braxton hicks contractions at a shop less than 5 mins away from home stupidly we thought it would be ok for him to just nip us home even tho he is disqualified it was just a moment of madness i just wanted to get home and he was worried as i was in agony we tried to explain this to the court but because of all his other offences they sent him to prison for 4 months. He has applied for hdc and i've written a letter to the Governor to plead with him as we already have 2 children and this one will be here in 6 weeks or less so he wont be out in time but as he has been a total idiot in the past about 8-9 year ago he was released on hdc and was recalled to prison for ripping the tag off i just want to know if anyone thinks there is a chance he could still get it? it was such a long time that happened plus they have posted a note through his cell door to say the prison is over crowded to he could be shipped out which is half way across the uk so no one would be able visit especially me in my condition i'm hoping that the over crowding is a good sign and may consider him for it?? opinions please
